Bi-Bag and Bi-joux trademark and bi-bag.it, bibag.it, bi-bag.com, bi-joux.com websites are the property of PostersCity Srl with registered office in Milan, Via V. Monti, 8, Italy, VAT number 06275890967. The company PostersCity srl, hereinafter referred to as “Bi-Bag”, sells Bi-Bag and Bi-joux brands products.
The use of the online sale system described in the general sales conditions below is exclusively reserved to the final consumer (referred to as “The Customer”) who acts exclusively on his/her own behalf and is a European Union resident.
These sales conditions apply to all sales of products made through www.bi-bag.com <http://www.bi-bag.com/> and delivered throughout the European Union.
The Customer shall carefully read these conditions before completing the online purchasing procedure. Placing a purchase order through the website shall constitute full knowledge and acceptance of these general sales conditions.
Therefore the Customer commits to the terms and conditions below in his/her relationship with Bi-Bag, acknowledging that Bi-Bag is not bound to terms and conditions other than the following, if not previously agreed in writing.
These general sales conditions shall be applicable and in force as long as they are accessible through the website www.bi-bag.it. Any modification to the general terms and conditions implies that the all new transactions entered into after the effective date of any such modification shall be governed by the modified terms and conditions.
Items on Bi-Bag.com may be purchased, while stocks lasts, by anyone over the age of 18 who has residence and/or domicile in one of the member states of the European Union.
Orders shall be placed upon registration, after creating a personal customer account, following the steps and instructions specified on the website.
Bi-Bag reserves the right to accept the orders received, and commits to communicate the Customer if orders cannot be accepted.
In accordance with article 53 of the Consumer Code, the Customer shall receive, at the time of performance of the contract, written confirmation of the product ordered and the total amount, with details concerning product price and shipping charges, procedures and deadlines for the return of the goods and information about after-sales services and any existing guarantees.
Orders placed from Monday to Friday by 1.00 p.m. (Italian time - GMT+1) are dispatched the following day. More generally, after an order confirmation email is sent, delivery times will depend on the type of delivery selected. Orders may suffer delays in dispatch and delivery due to public holidays:1st January, 6th January, Easter and Easter Monday, 25th April, 1st May, 2nd June, 15th August, 1st November, 8th December, 25th December, 26th December.
Sales may be suspended should any unforeseen circumstances or force majeure prevent or delay the performance. Bi-Bag shall inform the Customer of the occurrence of such circumstances or force majeure within 7 days after their occurrence.
Should services be suspended for more than 15 days, the Customer may cancel the order and be reimbursed the amount he/she has paid.
Prices are inclusive of all taxes and levies, excluding delivery costs.
The price of each product, as well as delivery cost, shall be communicated to the Customer prior to the conclusion of the contract. All prices are quoted in Euros and are inclusive of VAT.
Bi-Bag constantly makes sure that all prices on the website are accurate, without being able to guarantee absence of error. Should any errors concerning product price be found on the website, Bi-Bag shall give the Customer the opportunity to re-confirm the order at the accurate price or cancel it.
Payment by the Customer, made exclusively by credit card, will be debited as soon as the order is placed and ready to be delivered.
In order to prevent Internet fraud, payments made through www.bi-bag.it are managed online by the bank concerned through the online tools provided by PayPal.
Such companies are responsible for storing and managing the information concerning each order, including financial information, in a safe environment.
All financial information, such as credit card number, expiry date, etc, is directly managed by the relative bank sites which guarantee secure online transactions. Bi-Bag has no knowledge of the credit card details and is therefore unable to file or retain them in any way.
Therefore, Bi-Bag delegates customer’s support to Paypal throughout the entire payment process (www.paypal.com).
Should, for any reason, the debit of the amount due by the Customer be impossible, the sales process is automatically canceled and the sale automatically rescinded.
The official currency is the Euro. For non-participating Member States the exchange rate depends on the Customer’s credit card operator.
For purchases to be delivered, the Customer can choose their own permanent or current address, workplace address or the address of a person of their choice, whose permanent or current address is inside the European Union.
Products are delivered to the address provided by the Customer only after payment has been successfully registered.
In case of defective packages, the Customer shall open the package in the presence of the courier and check the state of the product inside.
If the product is damaged, the Customer shall report any damages in writing on the delivery note, and take pictures documenting the damage.
Bi-Bag shall repair or replace for free any product which has been damaged or lost during delivery by our forwarder, on condition that the Customer has reported the damages in writing, via email, to the address firstname.lastname@example.org.
If the product is damaged, the Customer is also requested to provide Bi-Bag with the receipt or other documents concerning the product in question, along with the original packaging. The Customer is also required to make sure that the products received correspond to those ordered. If the products delivered are not the same as ordered, the Customer shall inform the Customer Service via telephone or email and return the items following the terms and conditions in the “Right of Withdrawal” section of these general sales conditions.
Bi-Bag wishes to guarantee full satisfaction to its Customers.
If, for any reason, the Customer is not satisfied with the order, or the products delivered do not conform to those requested, they can be returned within 10 (ten) days from delivery date, in accordance to article 64 of the Consumers' Code.
The right of withdrawal may be exercised exclusively by the Customer and under no circumstances by the recipient of a gift.
Acceptance of returns may be accepted upon authorization by Bi-Bag.
The Customer may exercise their right of withdrawal by sending written communication to email@example.com , indicating the order number for which they intend to exercise their right of withdrawal and the reason.
The Customer will then receive a written authorization by Bi-Bag, and will be also provided with a return code and a return form to enclose inside the package containing the items to be returned.
The Customer can choose their own delivery courier. We suggest you choose couriers providing tracking number and return receipt services.
Should the procedure above not be followed, returns will not be accepted.
All risks regarding returns are responsibility of the Customer.
Reimbursement is made to the Customer’s bank account corresponding to the credit card used for payment. It is understood that, in accordance to article 67 of the Consumer Code, the integrity of the product shall be an essential prerequisite for the exercise of the right of withdrawal. Therefore, if the items returned has been used or damaged, they will not be reimbursed.
Bi-Bag commits to provide the best service possible. However, technical inaccuracies may occur. Bi-Bag reserves the right to make changes and corrections to the website whenever necessary with no prior notice.
Bi-Bag tries to display products and colors on the website in the most truthful and accurate way. However, the display of colors depends on the user’s monitor and Bi-Bag cannot guarantee that the Customer’s monitor displays colors in a perfectly faithful manner.
Apart from acts with criminal intent or serious negligence, Bi-Bag shall not be deemed responsible towards the Customer in any of the following cases:
• - Any loss or damage caused by the products (or their use by the Customer), without prejudice to the application of the regulations concerning producer's responsibility;
• - Any damage caused by non-fulfillment by Bi-Bag;
• - Any loss of business or business opportunity.
Within the limits above, Bi-Bag’s responsibility shall not exceed the price paid by the Customer for the product which has caused the damage.
